MINUTES OF A MEETING OF THE TOWN OF COLUMBUS,
COLUMBUS, MONTANA HELD JULY 6, 2009 AT 7:30 P.M.
The meeting was opened with the Pledge with Mayor Woltermann presiding. Council persons present were Gary Anderson, Terry Nystul, Jon Brown and Harold Houghton. Patty Sundberg and Paul Edwards were absent. Officers present were Fire Chief Cowger, Chief Pronovost, DPW Holten, Attorney Howard and Clerk Barndt.

The Mayor stated that this was the time and place advertised for Public Hearing on the ordinance Amending the 2006 Town of Columbus and Stillwater County Subdivision Regulations. He asked three times if there were any comments. Hearing none he declared the hearing closed at 7;41 p.m.
The Mayor asked Council if they had reviewed the minutes of the 6/15/09 meeting and were there any additions, deletions or correction? Nystul moved to approve the minutes as written, seconded by Brown, roll call; all-yes.
The Mayor asked Council to approve the claims. Houghton move to approve the claims for June 2009, seconded by Nystul, roll call; all-yes.
Petitions and Communications
Mike Segota, Whitlock’s Steakhouse, was here with two requests. The first was permission to close one block of South Diamond Street between 3rd Ave. South and Palladium for a street dance on July 11th. This request has come to Council in the past. Chief Pronovost asked Mike if he was going to have wrist bands for alcohol? Mike said that if anyone did not have ID or a band, they would not be served. Dennis was OK with the request. Houghton moved to approve the request to close the street for the dance, seconded by Nystul, roll call; all-yes.
The second request was for a one time exception to the fireworks ordinance to allow class three fireworks to be shot in the street during the dance. Attorney Howard said that any past requests of this kind required insurance naming the Town for the event. Segota said that he had $500,000 insurance for his premises and would get a rider if needed. Doug said that he should contact representatives of CCAN as they have coverage also. Nystul moved to approve the request provided our Attorney gets the requested documents, seconded by Anderson, roll call; all-yes.
Reports of Officers
Rich had nothing further to report. Council had no questions.
There were no questions for Bill.
Dennis gave a short report on his findings of the utilities located in Block 6 of Norton’s Second Addition. He stated that there are utilities in both the main East/West alley and the North/South stub alley. He recommended that the Town not abandon any of the portions requested in the petition received from area property owners. He said that it would be OK for Council to permanently close portions though. Mayor Woltermann suggested that this be placed on a future agenda and that the petitioners be asked to revise their request.
A color coded map was attached to his report for Council to review.
The next item was a report on the meeting at Town Pump. Town Pump is not excited about reversing the truck traffic pattern as it will be expensive to redo their diesel pumps. They did recognize that there is a truck traffic problem. The idea of signing the area to require trucks to enter at their second entrance. This would require some internal parking lot signage also.
It was pointed out that all trucks that exited 8th Avenue that day, crossed the center line as they turned right. MDOT has told Town Pump to get the curb and guttering fixed on their second entrance.
Dennis reported that sprinkler work at the Cemetery is progressing nicely. They have purchased the last of the needed materials to complete it and hope to get water going soon.
The foundation is complete at the Heritage Park Well Building so the sprinkler repairs can be done there and get water back on there also.

Unfinished Business
The first item was the second reading of the Subdivision Amendment. Nystul moved to waive the reading, seconded by Brown, roll call; all-yes.
Houghton moved to adopt the ordinance on second reading, seconded by Nystul,

AN ORDINANCE AMENDING THE 2006 TOWN OF COLUMBUS AND STILLWATER COUNTY SUBDIVISION REGULATIONS
The question was called for, roll call; all-yes, ordinance adopted.
New Business
The first item was the sewer bids for Carr/Annin/307. Dennis stated that eight bids were received and COP Construction, LLC was the low bid at $166151.00. Houghton moved to accept the low bid and approve the Mayor signing the Notice of Award, seconded by Brown, roll call; all-yes.
There were no comments not on the agenda.
